County settles lawsuit over appointments to DSS board

Yancey County officials have settled a lawsuit filed by two residents over their appointment to the county Department of Social Services board.
The settlement, struck Monday - the day the lawsuit was to go to trial - means Peter Franklin will be apppinted to the DSS board in July for a three-year term.
In their suit, Franklin and Tamara Frank had argued that the county commission, prior commissioners, and other county leaders had wronged them by not accepting their appointment to the board in November 2008. The case had been heard in court, been appealed, and been returned to Yancey County Superior Court.
The agreement was signed Monday, May 9, by Franklin, Frank, their attorney, County Commission Chairman Johnny Riddle, and county attorney Donny Laws after the county commission approved the settlement.
